KM Travel Agency LLC Terms & Conditions (T&Cs)
Please read the terms stated below, before using this website. If you do not agree with any part of these terms and conditions, please do not use this website or the Agency’s services.
KM Travel Agency LLC, d/b/a KM Travel, herein referenced as the Company or the Agency, is located in Atlanta, GA mailing address PO Box 90386. The Agency contracts with suppliers and vendors to offer vacation packages to individuals, families, and groups, herein referenced to as the client, the customer, the traveler, or travelers.
PRICING
All prices are quoted in U.S. Dollars and are confirmed with a minimum deposit. In some cases, full payment is required and will be indicated at the time of booking.
Pricing is subject to change without notice and DOES NOT include Travel Insurance, passport fees, visa fees, and some foreign government taxes that are paid locally at the resort or hotel.
Unless otherwise indicated gratuities, porterage, resort fees, local fees, and energy surcharges are not included in the package cost.
IDENTIFICATION
Travel documents and identification must be valid for travel. The Agency is not responsible for failure to present valid or proper travel documents. Any fees resulting in denied entry or a delay in travel are the sole responsibility of the traveler.
GENERAL
Clients are responsible for ensuring all names on the reservation match the travel documents they will be using for travel.
Specific room requests such as number and size of bed, location, connecting or adjoining rooms are all requests made to the hotel or resort and are never guaranteed. The Agency is not responsible for any room requests that are not available.
In some instances, the contracted supplier may cancel or change the traveler’s reservation due to an unforeseen circumstance or overbooking. The Agency will make every effort to work with the supplier, hotel, or air carrier to secure a new comparable reservation. The Agency accepts no liability or fault in the event a cancellation or change in booking occurs.
The supplier contracted for your booking may have a more restrictive Terms and Conditions Policy and in this case the hotel, resort, or suppliers policy will prevail over the T&C of this Agency.
TRAVEL PROTECTION
The Agency is not a provider of Trip Protection Insurance. Trip protection is always RECOMMENDED and can be purchased along with your package. It is recommended that you purchase trip protection within 5 days of your booking.
BOOKING & PAYMENTS
All prices are quoted in U.S. Dollars and are confirmed with a minimum deposit. In some cases, full payment is required and will be indicated at the time of booking. Deposits are non-refundable unless otherwise stated at the time of booking.
All payments must be made using a valid credit card in the customer’s name. We accept American Express, Visa, MasterCard, and Discover Card.
Payment plans are available for nominal fee. The minimum deposit must be paid first in order to secure the reservation for a payment plan. The customer is responsible for paying the balance in full by the Final Payment Deadline regardless of the payment arrangements made.
Final Payment Deadline is typically 45 days before departure unless otherwise stated at the time of booking. Reservations with an unpaid balance after the 45 days before departure are subject to cancellation due to failure to pay. Any fees incurred to restore the reservation is the responsibility of the client.
INITIAL CONSULTATION
Initial Consultations are complimentary. To book your consultation you must use the Consultation Request link available on the website. A form will be sent to you to complete prior to your appointment. Additional follow up questions will be asked to ensure we have the necessary details to plan your trip. This consultation is also an opportunity for us to get acquainted and determine if we are a good fit. The Agency reserves the right to decide if they are able to provide the services requested and if a good working relationship can be established with the client.
RESEARCH FEES
Research Fees are established to ensure the trip you want is the trip you get by conducting extensive research. The fee starts at $100 for basic research and can go up to $250 for a comprehensive trip including groups or international travel. The fee is assessed after the initial consultation and must be paid within two days of receiving the Research Fee invoice and no later than 5 days to retain the Agency services. Research Fees are non-refundable.
TRIP PROPOSAL
The Agency will provide a detailed Trip Proposal based on the must-haves discussed with the client during the Initial Consultation and after the Research Fee has been paid. The Trip Proposal will include up to 2 packages for comparison with property description, images, a suggested itinerary if called for, and pricing.
If any detail of your trip has changed after the Initial Consultation, you must immediately notify the Agency of the specific changes. Changes made after the Trip Proposal is complete can result in a minimum $25 change fee charged to the client to receive an updated proposal.
Trip Proposals are typically available for the client within 5-10 business days after the Consultation and Research Fees are paid in full. Customers may have up to 5 days to review and consider the Trip Proposal and ask the Agent follow-up questions or requests adjustments during this period. After 5 days of receiving the Trip Proposal, the customer must either make a deposit or inform the agency if they do not wish to book.
Every attempt will be made to identify the best package for the client based on what the client communicates in the Initial Consultation. In the event the client is dissatisfied with the selection/s of the initial Trip Proposal, the client must specify what they like and do not like about the options presented in an email with a request for another Trip Proposal. The Agent will have 5-10 days to present a final selection to the client. The client will have 3 days to review, ask questions, or make a deposit.
Should the client decide not to book, there will be no penalty or additional costs charged to the client. Any additional Trip Proposal request made by the client will require an additional Research Fee.
BOOKINGS & RESERVATIONS
Bookings and reservations are confirmed with payment and once the customer has completed the contact form containing full name, address, date of birth, and passport details required for travel.
NAME CHANGES
It is the customer’s responsibility to ensure all names in the reservation match the actual travel document being used for travel and report discrepancies immediately.Name corrections made 24 hours after booking will incur a fee to be paid by the customer. Unless otherwise noted, full name changes cannot be made and will require a completely new booking, and are priced at the time of booking.
TRAVEL DOCUMENTS
Customers are responsible for all personal travel documents and ensure it is valid through the end of their travel dates and is an exact match to the reservation.
KM Travel Agency bears no responsibility for any change fees, cancellations, or trip interruptions caused by improper documentation of names listed on the documents.
For travel outside of the U.S. that requires a passport, customers must present a valid passport with an expiration date of 6 months or beyond the actual return date of the trip. A blank or open page in the passport book must be available for travel and the document must not be excessively worn or defaced in any way. US Passport requirements can be found at https://travel.state.gov/content/travel/en/passports.html.
Travel visas, immunization records with required inoculations, health records, or COVID negative test results may be required for travel. It is the customer’s responsibility to determine the items required for entry for everyone in the reservation.
HEALTH REQUIREMENTS & COVID:
Travelers are responsible for complying with all health requirements established by local authorities in the locations they are traveling to, from, or transferring in.
TRAVELING WITH MINORS
For families traveling with minors out of the US, you may be required to present additional documents verifying the minor/s and parent permission to travel. It is the responsibility of the adult traveling to ensure requirements are met and documents are available to be presented to authorities during travel.
TRAVELING BY AIR
Airline reservations are booked once full payment is received and is typically sold in a travel package unless stated otherwise. Land-only packages are available by request.
Airline pricing is always subject to change without notice. Airport taxes, Government Fees, and Destination taxes can increase without notice. Customers will be billed for any increase in travel fees associated with the booking.
KM Travel Agency will make every effort to confirm your seat selection. Air Carriers reserve the right to change the seating of passengers or remove seat assignments without notice. In some cases, your flight may have reached a capacity that doesn’t allow seating together. Seating requests can be made with the carrier at the gate of departure.
Checked bags and carry-on bag allowance are established by the air carrier. Customers must follow all rules and regulations for the carrier and government agency’s acceptance and prohibited items list found on the corresponding website. You must review this information before you pack for your trip. Any additional fees incurred by exceeding the bag allowance or weight requirement are to be paid by the customer directly to the carrier. Any fees assessed and charged to KM Travel Agency will be billed to the customer to be paid upon receipt of the invoice.
Purchase upgrade requests can be made at the time of booking or after booking.
Program Loyalty numbers can be added to the reservation at the time of booking or after booking but must be made by a set time upon arrival based on the carrier program. The use of points or miles for your booking may be available and must be requested before the booking is made.
PHOTOGRAPHS & VIDEOS
KM Travel Agency reserves the right to use any photograph or video taken during customer’s travel booked by the Agency without the express written permission of those included within the photograph and video. The Agency may use the photograph and video in publications or other media material produced, used, or contracted by KM Travel Agency, including but not limited to: websites, social media, and brochures. Any traveler desiring NOT to have their photograph and video published by the Agency must contact KM Travel Agency by email at [email protected].
RELEASE FROM LIABILITY:
The Agency does not own or operate any entity that provides services for your trip. This includes ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers, or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, The Agency is not liable for any negligent or willful act or failure to act of any such person or entity, or any other third party.
Without limitation, KM Travel Agency is not responsible for any of the following: injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind.
KM Travel Agency LLC is also not responsible for the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failures of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of medical or other emergencies, illness, epidemics or the threat thereof or for any other cause beyond the direct control of KM Travel Agency. In addition, I release KM Travel Agency from its own negligence and assume all risk thereof.
VOLUNTARY ACCEPTANCE OF THESE TERMS AND CONDITIONS
The Agency reserves the right, in its sole discretion, to modify or cancel this agreement without prior notice to you.
I agree and understand that KM Travel Agency LLC and/or their agents can accept no responsibility for losses or accidental expenses due to delays or changes in airline/rail or other means of transport schedule, hotel overbooking or default, sickness, weather, strikes, war, quarantine or other causes.
I have carefully read these Terms and Conditions and the booking information sections of this document, and fully understand its contents. I am aware that this is a release of liability and a contract between myself and KM Travel Agency LLC, and I agree of my own free will.
